That if the Jury believe that the Deft: contracted with the Husband of the Petr: (a free man) for the purchase of the Petitioner at the price of 400$; which & that the said Husband had agreed to pay the said sum of money as the price of the Petr: then the Petr is entitled to her freedom such contract is evidence of an importation contrary to the act of assembly of 1796. Unless the the Jury should from the circumstances given in evidence shd. believe that the Deft. had no intentions when he brought in the Petr. of selling her or her being sold or residing therein in this County.
